By accessing or using the Lokshen Delivery web/app platform, you agree to be bound by these Terms & Conditions.
1. Eligibility
- You must be 18 years or older to use the platform.
- Customers must be 18+ and present valid ID for liquor orders.
- By registering, you confirm that the information you provide is accurate and up to date.
2. Use of Platform
- You may not use the platform for any illegal or unauthorized purpose.
- You may not interfere with or disrupt the platform’s operation or security.
- You may not create multiple accounts to abuse promotions or platform terms.
3. Orders & Deliveries
- Orders placed through the platform are binding once confirmed.
- Delivery times are estimates and may be affected by traffic, weather, or vendor availability.
- Liquor orders may be refused where ID verification fails or the customer appears intoxicated.
- Delivery or service fees may not be refunded in restricted liquor-delivery cases.
4. Vendor & Driver Responsibilities
- Vendors must keep products, pricing, and store hours accurate.
- Drivers must hold valid driving documentation and follow traffic laws.
- Drivers and vendors are responsible for compliance with applicable laws, taxes, and safety requirements.
5. Payments & Payouts
- Payments are handled securely through third-party payment processors.
- Vendors and drivers receive payouts weekly, every Monday.
- Delays caused by banks, payment gateways, or technical issues are outside the platform’s control.
6. Suspension, Termination & Liability
- Accounts may be suspended or terminated for fraud, abusive conduct, or policy violations.
- Pending payouts may be withheld where fraud, chargebacks, or regulatory issues are under investigation.
- Lokshen Delivery is not liable for delivery delays, vendor product quality issues, or acts of third parties.
7. Privacy & Data Use
- Your personal data is collected and used to facilitate orders, payments, deliveries, support, and fraud prevention.
- Location data may be used for delivery tracking and address accuracy.
- Lokshen Delivery states that customer, driver, and vendor personal information will be protected.
8. Refunds & Cancellations
- Refunds may be considered for wrong items, damaged orders, undelivered orders, or cancellations before preparation/purchase.
- Refunds are generally not available if the wrong address was provided or the customer was unavailable.
- Refund requests should be submitted with order details and evidence, and reviews may take 1–3 business days.
9. Shipping & Delivery Policy
- Lokshen Delivery currently operates in Rustenburg, Mogwase, and Brits, with expansion into North-West Province.
- Typical same-day delivery is within 30–90 minutes.
- Customers can track orders in real time via the app.
- If a customer is unreachable, the driver may wait 10 minutes and the order may be returned.
10. Governing Law
- These terms are governed by the laws of South Africa.
- Parties agree to attempt amicable dispute resolution first.
- Unresolved matters may be referred to South African courts or confidential arbitration at Lokshen Delivery’s discretion.
